Terms of Service

1. About these terms

These Terms of Service (the “Terms”) form a binding agreement between you and General Department of Taxation (GDT) Tower (“GDT Tower”, “we”, “us”, “our”) governing access to and use of the GDT Tower website at gdttower.tax.gov.kh, the GDT Tower Tenant mobile application for iOS and Android, and the related back-end services (together, the “Services”). Our Privacy Policy, available at gdttower.tax.gov.kh/privacy, is incorporated into these Terms by reference.

2. Eligibility

You must be at least 16 years old and able to enter into a binding contract under the laws of Cambodia (or your local jurisdiction) to use the Services. The GDT Tower Tenant mobile application is provided exclusively to occupants and authorised personnel of tenant companies that lease space in GDT Tower. Access to the app requires a profile pre-provisioned by the GDT Tower facility administrator on behalf of your tenant company; the app does not offer public sign-up. If you do not hold a pre-provisioned account, you may not use the Tenant app.

The public website is available to the general public for the purpose of browsing the building and booking meeting rooms, ballrooms and auditoriums.

3. Your account

• Tenant app accounts are created in advance by the GDT Tower facility administrator on behalf of your tenant company. You sign in to your provisioned account using Sign in with Apple or Google Sign-In, and are responsible for maintaining the confidentiality of the device and the third-party account you use to sign in.
• You must keep your profile information accurate and notify your tenant administrator of changes (for example, role, unit or contact details).
• You must notify us promptly if you believe your account has been accessed without your authorisation, by emailing gdtapp@tax.gov.kh.
• You are responsible for all activity carried out under your account, including visitor pre-registrations, room bookings and maintenance tickets.

4. Acceptable use

You must not:

• Use the Services for any unlawful purpose or in breach of these Terms.
• Pre-register a visitor without their informed consent, or pre-register a person you have no legitimate reason to host in the building.
• Submit false, misleading or malicious information, including fake maintenance tickets or visitor records.
• Attempt to gain unauthorised access to any part of the Services, the underlying infrastructure, other accounts or any building system.
• Probe, scan, reverse-engineer, decompile or disassemble the Services, except where such restriction is prohibited by applicable law.
• Use any automated means (bots, scrapers, robots) to access the Services.
• Interfere with the operation of the Services, including by sending excessive requests, distributing malware or circumventing rate limits.
• Resell, sublicense or commercialise the Services or any part of them.

5. Visitor pre-registration

When you, as a host, pre-register a visitor through the Tenant app, you confirm that you are authorised to invite the visitor to the building and that you have obtained the visitor’s informed consent for the collection and processing of their personal data, including any photograph or identity-document scan you submit. You are responsible for the accuracy of the information provided.

GDT Tower may refuse entry to a visitor whose identity cannot be verified, who does not satisfy building security policy, or whose pre-registration appears to violate these Terms or applicable law.

6. Building services and notifications

The Tenant app surfaces building operations such as maintenance ticketing, announcements, parking requests, meeting room booking and emergency notifications. We work to deliver these services promptly but we do not guarantee any specific response time, except as separately agreed in your tenancy agreement or service level agreement.

Emergency alerts delivered through the app are intended to assist building safety but should not be relied on as your sole source of warning. Always follow on-site instructions, evacuation signage and the directions of emergency personnel.

7. Meeting room, ballroom and auditorium bookings (website)

The following terms apply to bookings made through the public website at gdttower.tax.gov.kh:

• Bookings require a 50% deposit at the time of confirmation. The remaining balance is due on or before the day of the booking.
• All payments are processed by PayWay (ABA Bank) using KHQR — Cambodia’s national QR-code payment standard. You complete the transfer in your own banking app, and your use of PayWay is subject to its terms and privacy policy in addition to ours.
• Cancellation 24 or more hours before the start time entitles you to a full refund of the deposit. Cancellation within 24 hours forfeits 50% of the deposit. Failure to attend (no-show) forfeits the full deposit.
• Rooms must be used only for lawful business purposes. You are responsible for any damage to the room, fixtures or equipment caused by you or your guests during the booking, and for leaving the room in a reasonable condition.
• We may relocate a booking to a comparable space, or cancel it with a full refund, if circumstances beyond our reasonable control require us to do so.

8. Mobile app licence

Subject to your compliance with these Terms, GDT Tower grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the GDT Tower Tenant app on a mobile device that you own or control, solely for the purpose of using the Services as an authorised tenant occupant.

All right, title and interest in and to the Services, including all intellectual property rights, are and remain the property of GDT Tower and its licensors. No rights are granted to you other than as expressly set out in these Terms.

9. Third-party services

The Services rely on third-party platforms, including Apple App Store, Google Play, Apple Push Notification service, Firebase Cloud Messaging, Sign in with Apple, Google Sign-In, and PayWay by ABA Bank (KHQR payments on the website). Your use of those platforms is subject to their own terms and privacy policies, which are not under our control.

10. Disclaimers

To the maximum extent permitted by law, the Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy or uninterrupted operation.

We do not warrant that the Services will be available without interruption, that defects will be corrected, or that the Services or the servers that make them available are free of viruses or other harmful components.

11. Limitation of liability

To the maximum extent permitted by law, GDT Tower and its officers, employees, agents and licensors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or in connection with your use of, or inability to use, the Services, even if advised of the possibility of such damages.

Our total aggregate liability arising out of or in connection with the Services will not exceed the greater of (a) the total amount you paid to us in the twelve months preceding the event giving rise to the liability, or (b) USD 100. Nothing in these Terms limits any liability that cannot be limited under applicable law.

12. Indemnification

You agree to indemnify and hold GDT Tower harmless from any claim, loss, liability, demand, damage, cost or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Services, your submission of inaccurate visitor information, or your violation of the rights of any third party.

13. Suspension and termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have breached these Terms, your tenancy at GDT Tower has ended, your continued access poses a security risk, or we are required to do so by law.

You may stop using the Services at any time by uninstalling the app and requesting account deletion as described in our Privacy Policy. Sections 8, 9, 10, 11, 12, 15 and 16 survive termination.

14. Changes to the Services and these Terms

We may modify, suspend or discontinue any part of the Services at any time. We may also revise these Terms; the “Last updated” date above indicates when they were last changed. Material changes will be notified through the app or by email at least 14 days before they take effect. Your continued use of the Services after the effective date constitutes acceptance of the revised Terms.

15. Governing law and disputes

These Terms are governed by the laws of the Kingdom of Cambodia. Any dispute arising out of or in connection with these Terms or the Services will be referred first to good-faith negotiation between the parties; failing resolution within 30 days, the dispute will be submitted to the competent courts of Phnom Penh, except where applicable consumer-protection law gives you the right to bring proceedings in the courts of your place of residence.

16. Apple App Store additional terms

The following additional terms apply where you obtained the Tenant app from the Apple App Store:

• These Terms are entered into between you and GDT Tower only, and not with Apple Inc. (“Apple”). Apple is not responsible for the app or its content.
• The licence granted in Section 8 is limited to a non-transferable licence to use the app on any Apple-branded device that you own or control, as permitted by the Apple Media Services Terms and Conditions.
• Apple has no obligation to provide any maintenance or support services for the app. Any questions or support requests should be directed to gdtapp@tax.gov.kh.
• In the event the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you. Apple has no other warranty obligation in respect of the app.
• Apple is not responsible for addressing any claims by you or any third party relating to the app or your possession or use of the app, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and consumer-protection or similar claims.
• In the event of any third-party claim that the app or your use of it infringes that third party’s intellectual property rights, GDT Tower — not Apple — will be solely responsible for the investigation, defence, settlement and discharge of any such claim.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

17. Google Play additional terms

Where you obtained the Tenant app from Google Play, your use of the app is also subject to the Google Play Terms of Service. Google LLC is not a party to these Terms and is not responsible for the app or its content.

18. Miscellaneous

• These Terms, together with the Privacy Policy, constitute the entire agreement between you and GDT Tower in respect of the Services.
• If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect.
• Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
• You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign them without restriction.
